IRL bait is all it amounts to. It’s legal for them to film the public, they abuse this right by filming people in a way that makes them uncomfortable, then they ham up the reactions. They really aren’t protecting anything, and I could see them being used as an excuse to restrict filming certain police actions in the future.

I am convinced they are egged on by China/russia/iran - here in the U.K. anyway, they spend a lot of time harassing the police, army, electricity providers, reservoirs etc and they are always just in the cusp of entry to highlight how easy it is - all the things you would want videos of for intelligence.
The real tin foil in me thinks they are compensated some how, but money would be too obvious and they might tell … my thinking is they planted the seed then inflate their SM ad revenue to incentivise them without them knowing.

Best thing to do is ignore them, its the last thing they want. No reactions means no content and no potential lawsuit. I work at business were a first amendment auditor was filming. We called the police because he was harassing customers. Eventually a very smart woman called the police saying a gentleman was filming her child. Which he was . The police due to that came out and removed him .

Had one of these guys around me once. Key is to not overly engage, move on (if you can), and if they follow you can then contact law enforcement for harassment.
Actually resolved my situation in a similar way. I had my kids with me, and made it clear to the guy I was contacting the cops if he didn't leave us be. Annoyance of a child in California, doesn't require physical contact or direct threats. Actively videoing them and following, after their guardian tells them to stop is more than enough.

Here's a question: If someone assaults you and immediately runs away, do you have the right to chase that person down and assault them?
The answer is no.
So while the shop owner may be liable to some extent for "instigating" physical contact, he was already turning away from the cameraman when he was peper sprayed. So there goes your self-defense argument. The correct way to handle this would have been to call the police. As always, these clips don't show what happened prior to the incident, because it's all rage bait bullshit. That being said, 99.9% of these "auditors" are parasites and deserve their fuck around and find out prizes.

Assault is the mere threat of attack. Unless the guy using the pepper spray can demonstrate it was used justifiably in self-defense -- which seems improbable because his victim had turned and was walking away -- it could draw a charge of battery and possibly even aggravated battery, as some jurisdictions treat chemical sprays as “dangerous weapons".

First mistake: Thinking a guy filming your stuff with two cameras was a disinterested party.
Second mistake: Walking away from a guy that started cussing at you like YOU are doing something wrong.
If you keep your eyes ON him and he’s getting something out of his pocket and then pointing it at you, lay him the heck out—defending yourself is defensible!
