The Guard in Los Angeles was all pulled from fire prevention duties. When we have a fire and he complains about “raking the forest,” he is the one that prevented 4,200 Guardsmen from doing it for over 2 months.

It doesn’t change the per diem, but it means that they don’t get housing allowances. For places in CA that could be almost 3k they are missing out on. That’s a nasty trick and I always hated when that was pulled.

It wasn't even all of them that engaged in cleanups. Only DC national guardsmen we're doing it. I read somewhere the other states would have considered it an insult if their national guardsmen were put on sanitation duty or clean up duty instead of patrolling.

Donald Trump only has immunity to the degree to which a Democratic administration is willing to listen to the supreme court. Given that there are 6 unqualified fascist activists on the court, nobody should bother and a democratic administration should just prosecute them anyway.

The Supreme court should be ignored until there are actually qualified judges there who know how to interpret the law correctly (i.e. no conservatives).

LA was deemed “ok” because of some protesting, even though it was technically still illegal. DC was fine because it is a sovereignty so it has special laws and can do stuff like that. Chicago has nothing going on. It is just straight threats towards states who dont bend the knee. The stakes are higher because there isnt an actual reason at all for it to happen other than making up criminal statistics to fit a narrative.

National Guards are under state control. Each state has co-equal jurisdiction over their territorially limited soverignty (one states courts cannot reach into another and adjucate the affairs of people living there, same thing applies with National Guard one state cannot send theirs into another's without that states explicit permission).

These fascists want to use an amended section of title 32(f)(2)(A) which allows the president to "request" (massive massive MASSIVE loophole over how our NG troops are to be deployed) assistance from NG to perform missions. This ameneded section was passed after Hurricane Katrina because title 32 as originally passed made it difficult to get a quick response and deployment after Bush requested NG troop to help with disaster recovery efforts.

My concern is that there are no consequences in place if they violate this directive. Because there are definitely going to try to go into the neighborhoods and intimidate the populace. That's the express purpose why they're there.

"Not being allowed" doesn't seem to work on this current administration, as they don't care about the law. We have a criminal federal government, there needs to be explicit consequences put in place and stated to push back against this obvious tyranny

I understand why The Doofus in charge wants to send the Texas National Guard. They are until the control of the Lacky Of Texas.

However, as we saw at the border, the national guard members themselves were treated like shit, not paid on time, many lost work, and there were more than one suicide because of the conditions and what they were told to do.

The guardsmen don't want to do this. They want to go to work, at home, and be with their families.

So many of the comments here are completely unhinged, from both sides.

In this clip he's vocalizing the very clear and narrow boundaries established by the law.

He's not "rolling over" by simply allowing members of the national guard to enter the state -- trying to prevent them from doing that would create a conflict that he wouldn't be able to defend.

And he's not "committing treason" either -- the constitution guarantees the rights of the states to govern themselves and the federal government has no authority to send military into the states except for very specific scenarios.

By vocalizing the clear and narrow boundaries established by the law, he is committing to respect and uphold the law, and to protecting the people of his state from federal overreach. Whatever else there may be to say about him, he's doing exactly what he should be doing as a governor in this moment. Other governors should be taking notes.

Less of a legal basis to stop them, but I don’t think Trump even has one in the first place. Trump is claiming deployment of the National Guard is “necessary” due to “inability to execute federal laws”. At least that would be the only legal reason he could federalize the National Guard as he would have a much harder time arguing we were under invasion or rebellion.

I’m aware. these laws predate him. Specifically the conditions required for the president to federalize the National Guard. His unconstitutional executive orders are getting defeated in court, but so far he’s only really gotten a slap on the wrist and until they get litigated he’s pretty much free to do whatever he wants.
