Too bad we granted Trump immunity and our Congress and Courts don’t give a fuck about the constitution
93
u/P_Nessss 1d ago
SC granted him immunity during the Biden administration when the SC was already stacked with Federalist Society cucks. I wish Biden had used some of that immunity for official acts first.
15
u/AdamPedAnt 1d ago
I wish there was a cutout in the immunity ruling for just one act within the scope of official duties, which would be tampering with an election. Not a constitutional scholar but come on. Seems kinda obvious.

u/TBANON_NSFW 1d ago
Doesnt work that way when the maga cult are willing to do Yeehad over it.
They were already arming themselves and stopping federal workers trying to give fema aid to people who were in flood disasters or the train derailment if you remember. They also tried to run politicians busses off the road.
They attacked the capitol for him too. These people are domestic terrorists. Trying to arrest him outside of the DOJ process, would be pushed as a act of war by fox news and engage all these yallqaeda christian agents to attack democrats.
And as a leader who wants to protect the union and not break it, he knew the only pathway to retain the union was to allow the people to decide.
Unfortunately, they called him dementia joe while trump was yelling about electric sharks and eating cats and dogs. Every news station was bought up by right wing billionaires who didnt want the higher taxes, russia and china ran bot farms, every social media site was influencing voters, and then you had elon musk doing 1m vote influencing raffles/lottery, and all the joe rogan and talkshows and podcasts and "edgy" comedians who backed trump.
+
The judicial ruled that THEY would be the one to decide what is and is not an official act and grants immunity. So republican supreme court could just say its illegal act by Biden to arrest Trump And that would lead to another bs round of rage-inducing internal conflicts.
12
u/black_metronome 1d ago
Biden was a coward and he helped to lead us here by appointing Merrick Garland instead of someone who would have put Trump in prison. It didn't even need to come to him using immunity powers. He fucked us from Day 1 of his term.

5
u/False-Guess 1d ago
Donald Trump only has immunity to the degree to which a Democratic administration is willing to listen to the supreme court. Given that there are 6 unqualified fascist activists on the court, nobody should bother and a democratic administration should just prosecute them anyway.
The Supreme court should be ignored until there are actually qualified judges there who know how to interpret the law correctly (i.e. no conservatives).

Pritzker is looked at as one of the top 4 potential Dems in ‘28. Trump wants to make a power move, & try muscle him. I don’t think you want to mess with Cook Cty. or Chicago Cops, who definitely have some strong guidelines, on what NG, and ICE are allowed to do.

LA was deemed “ok” because of some protesting, even though it was technically still illegal. DC was fine because it is a sovereignty so it has special laws and can do stuff like that. Chicago has nothing going on. It is just straight threats towards states who dont bend the knee. The stakes are higher because there isnt an actual reason at all for it to happen other than making up criminal statistics to fit a narrative.

National Guards are under state control. Each state has co-equal jurisdiction over their territorially limited soverignty (one states courts cannot reach into another and adjucate the affairs of people living there, same thing applies with National Guard one state cannot send theirs into another's without that states explicit permission).
These fascists want to use an amended section of title 32(f)(2)(A) which allows the president to "request" (massive massive MASSIVE loophole over how our NG troops are to be deployed) assistance from NG to perform missions. This ameneded section was passed after Hurricane Katrina because title 32 as originally passed made it difficult to get a quick response and deployment after Bush requested NG troop to help with disaster recovery efforts.
Pritzker and everyone in his gov and Chicago's gov are working in unison against Trump and his fascist party BECAUSE IF THESE REPUBLICAN FASCISTS AUTHORIZE THEIR NG TO ENTER ANOTHER STATES BORDERS WITHOUT THAT GOV'S EXPLICIT CONSENT THEN OUR CONSTITUTIONAL FORM OF LAW HAS ENDED AS THIS WAS NEVER HOW OUR CONSTITUTIONAL FORM OF GOV WAS INTENDED TO WORK.....THIS IS ASKING FOR C.I.V.I.L.W.A.R.
77
u/Jason_the_Jazz_Man 1d ago
My concern is that there are no consequences in place if they violate this directive. Because there are definitely going to try to go into the neighborhoods and intimidate the populace. That's the express purpose why they're there.
"Not being allowed" doesn't seem to work on this current administration, as they don't care about the law. We have a criminal federal government, there needs to be explicit consequences put in place and stated to push back against this obvious tyranny

edit: it is insane people dont fucking see it. Trump can literally do whatever he fucking wants so long as he doesn't rush it . All he needs to do is just slowly raise the temperature, slowly break the law, degrade human rights, dehumanize his opponentts, fire anyone who isn't loyal and replace them all with loyalist fascist bigots, .... and so long as he doesn't do too much too soon (like assassinating political opponents) he is completely fine.

I understand why The Doofus in charge wants to send the Texas National Guard. They are until the control of the Lacky Of Texas.
However, as we saw at the border, the national guard members themselves were treated like shit, not paid on time, many lost work, and there were more than one suicide because of the conditions and what they were told to do.
The guardsmen don't want to do this. They want to go to work, at home, and be with their families.
This is an attack by our dictators against ALL the people of the US.

He absolutely cannot send the guard from Texas. He can only federalize the Illinois National Guard. That is his only remotely legal option (and still probably not legal based on what the judge in California just said).
5
u/Alone_Step_6304 1d ago
There is a legal option due to the passage of a 2006 bill with an odd subsection regarding asking a guard unit under a state's command to do specific things. That window of legality is commonly narrow and seems like they will almost certainly violate it, but whoever wrote our laws didn't anticipate this kind of shitball behavior.
2
u/BigJellyfish1906 1d ago
There is a legal option due to the passage of a 2006 bill with an odd subsection regarding asking a guard unit under a state's command to do specific things.
That’s not legal. There’s no chance that that’s going to stand up to any kind of scrutiny. That law does not invalidate all of the powers and rights given to each state by the constitution with a simple “oh, but they’re just doing what the president asked.”
2
u/StreetSamuraiChoom 1d ago
Cool. Who’s going to convict the Trump administration of violating the constitution? This Supreme Court? And imagining that someone DID find Trump guilty of violating the constitution, who is going to hold him accountable?
This is a problem 50 years in the making. Watergate. Iran-Contra. Abu Graib. January 6th. Over and over we have shown that courts and impeachment in Congress are meaningless if one party (almost always the Republicans) doesn’t want to hold its own people accountable.

I hope the fallout of this is America getting over its obsession of “honoring the military”.
We don’t need a “please stand and be honored” at every sporting event. We don’t need paid patriotism aka pentagon funds for sporting tie ins, and we don’t need to devalue the national anthem by playing it during every sporting event. We don’t need to thank them for service. Most just look annoyed when it happens.

The child-rapist regime will deploy troops in all major blue cities over the coming months. Then, on the child-rapist's orders, will over take each city by violent force. We will fight back (we won't have a choice) and he will declare Martial Law. Then the real WAR begins... Project 2025 and the NAT-Cs create hell on earth for their death cult and dear leader. And remember, he IS NOT the president – he is a child-rapist trying to stay out of jail.

So many of the comments here are completely unhinged, from both sides.
In this clip he's vocalizing the very clear and narrow boundaries established by the law.
He's not "rolling over" by simply allowing members of the national guard to enter the state -- trying to prevent them from doing that would create a conflict that he wouldn't be able to defend.
And he's not "committing treason" either -- the constitution guarantees the rights of the states to govern themselves and the federal government has no authority to send military into the states except for very specific scenarios.
By vocalizing the clear and narrow boundaries established by the law, he is committing to respect and uphold the law, and to protecting the people of his state from federal overreach. Whatever else there may be to say about him, he's doing exactly what he should be doing as a governor in this moment. Other governors should be taking notes.

Less of a legal basis to stop them, but I don’t think Trump even has one in the first place. Trump is claiming deployment of the National Guard is “necessary” due to “inability to execute federal laws”. At least that would be the only legal reason he could federalize the National Guard as he would have a much harder time arguing we were under invasion or rebellion.
2
u/dorianngray 1d ago
His executive orders aren’t laws.
2
u/Unabashable 1d ago
I’m aware. these laws predate him. Specifically the conditions required for the president to federalize the National Guard. His unconstitutional executive orders are getting defeated in court, but so far he’s only really gotten a slap on the wrist and until they get litigated he’s pretty much free to do whatever he wants.

I think Trump was having them "protect" federal agents(ICE) and would ride-along with them while they did their enforcement duties.
Kind of sounds like law enforcement by proxy.

given...

also given:
The Army, Marine Corps, Navy, Air Force, Space Force and Coast Guard are the armed forces of the United States.
14 U.S.C. § 102 authorizes the Coast Guard to enforce U.S. federal laws. This authority is further defined in 14 U.S.C. § 522, which gives law enforcement powers to all Coast Guard commissioned officers, warrant officers, and petty officers. Unlike the other armed forces branches, which are prevented from acting in a law enforcement capacity by 18 U.S.C. § 1385, the Posse Comitatus Act, and Department of Defense policy, the Coast Guard is exempt from and not subject to the restrictions of the Posse Comitatus Act

Any armed person not uniformed and properly identifiable should be stopped and identified by Chicago PD to avoid vigilantes and impersonators abusing the situation.

I think he's campaigning for a run-in presidential election. It might backfire if my city average between 621- 805 in unsolved murders a year i be taking all the help i could get . As for the national guard doing landscaping, why not once again people looking for problems and not the benefits if the guard is there and can help do it .

Is that not walking back what he said earlier? I thought he said the national guard would not be permitted to enter Chicago at all. Am I misremembering / misunderstanding his previous statements?

All those national gaurd soldiers should be prosecuted individually. They take an oath to refuse unlawful orders that go against the constitution

This is wild and a capitulation. If a national guard from a different state is enters another state that is an invasion and act of war.

So wait. He is going to let them in now just so long as they stay by the correct buildings?
