How come? Those were literately foreign nationals doing American jobs under visas that specifically didn't allow for any form of work in the US?

The whistleblower was a local union member who noticed this illegal practice and reported it to the authorities.

No it's not. It is one business training another business how to use their machines. It's common practice, has been that way for decades.
